The Court Case

Here is the documents that has been presented during the process and a copy of the sentence


Khalid and Asia arrived Sweden in June 2009. Shortly hereafter they applied for asylum. The migration office appointed a lawyer and their case were tried and the verdict announced one year later, the 9th of July 2010.

Their apply was rejected because the family had not made it likely (were not able to proof) that their existence were threatened in Pakistan. Their story was not good enough, so to speak.

All though Khalid and Asia wanted to have a new solicitor, because they where not satisfied with the one assigned to them, this wish was rejected with out any explanations. The court appointed lawyer then filed an appeal to the court. But all though Khalid himself attached more documents to strengthen his case, the family did not succeed.

There are thousands of cases from Pakistan where people have been harassed, violently assaulted, tortured and even killed for their way of life. The Swedish Foreign Office (UD) in a report from 2007 mention that especially minorities are the most vulnerable. Atheists and apostates, people that actively have left islam, are seen as the worst “criminals” and are automatically categorized as blasphemists. The police force does not work by the book and the last years most of those crimes (acc to Pakistani law) has been fixed as private affairs! That means that there is none – or at least very few – of these kind of cases that comes to court, most are taken care of in the streets in a severe way by the mob!

The religious freedom situation in Pakistan deteriorated greatly during the reporting period. While the Zardari government has taken some positive actions to promote religious tolerance and remedy abuses, it has failed to reverse the erosion in the social and legal status of religious minorities and the severe obstacles the majority Muslim community faces to the free discussion of sensitive religious and social issues. A number of Pakistan’s laws abridge religious freedom. Blasphemy laws are used against members of religious minority communities and dissenters within the majority Muslim community, and frequently result in imprisonment on account of religion or belief and/or vigilante violence. Three individuals had death sentences imposed or upheld against them during the reporting period.

The following link is very interesting. It is comments from an “experienced jury member” in the Migration Court, Per Edman, and can be read in its real environment:

It is worth to notice, that the 2 years rule that Per Edman mention here where observed from the court, so that a sentence could be made and announced before 24 months has passed. It is also obviously, that if Per Edmans statement about “likeliness” counts – which could be right for the Saeed case – then only people with “fixed” stories has a chance to go smooth through the system and win their asylum cases! (More about that other-where).

Here you can see how many readers this URL has from Pakistan compared to Sweden and other countries. App 400 seems to me to quite a lot, when we know that Khalid’s identity is not that very secret.

Khalid have received several e-mails from different persons that has been handed over to the Swedish police for investigation.
E-mail January 2011 - E-mail July 2011
The July e-mail was reported the day after Khalid received it and  filed as a crime committed 5th of June instead of July, but of course that can happen. The investigation has been archived the 19:th of July with the following reasons (translated from Swedish):

There are currently no tips or other ideas that makes it possible for the police to work on the case. The police are therefore waiting with active measures to more tips or other ideas are available to the police.
